Rules of service, responsibilities of the parties, and limitations of liability for the use of Eldavies.com hydraulic systems and related services.

1. Subject of Services

Eldavies.com provides design, manufacturing, and technical support for high-pressure hydraulic actuators and heavy-duty proportional valve manifolds intended for mining and civil excavation equipment. Our products incorporate advanced sealing technologies to prevent fluid leakage under extreme cyclical pressure, thereby extending the operational lifecycle of connected mechanical assets.

All services and products are provided strictly in accordance with the specifications agreed upon in writing between Eldavies and the customer. No implied warranties or additional services are included unless explicitly stated in a signed agreement.

2. Rights and Obligations of the Parties

2.1 Customer Obligations

The customer shall provide accurate and complete technical requirements, including but not limited to operating pressure ranges, environmental conditions, and integration parameters. The customer is responsible for ensuring that the products are used in accordance with Eldavies' installation and maintenance guidelines.

2.2 Eldavies Obligations

Eldavies commits to delivering products that meet the agreed specifications and applicable industry standards. Eldavies will provide reasonable technical support during the warranty period as defined in the product documentation.

  • Products are warranted against manufacturing defects for a period of 12 months from the date of delivery.
  • Warranty does not cover damage resulting from misuse, unauthorized modifications, or failure to follow maintenance instructions.
  • Eldavies' sole obligation under warranty is to repair or replace defective products at its discretion.

3. Limitation of Liability

To the maximum extent permitted by applicable law, Eldavies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or interruption of business, arising out of or in connection with the use or inability to use the products or services.

Eldavies' total cumulative liability for any claims arising under these terms shall not exceed the total amount paid by the customer for the specific product or service giving rise to the claim.

This limitation applies regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise.

4. Termination of Use

Either party may terminate the agreement for convenience by providing 30 days' written notice. Eldavies may immediately terminate or suspend access to services if the customer breaches any material term of these terms and fails to cure such breach within 10 days of written notice.

Upon termination, the customer shall pay all amounts due and return or destroy any confidential information belonging to Eldavies. Provisions regarding limitation of liability, warranty disclaimers, and governing law shall survive termination.

5. Changes to Terms

Eldavies reserves the right to modify these terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the services after any changes constitutes acceptance of the new terms. If you do not agree to the modified terms, you must stop using the services and terminate your agreement.

Eldavies will notify customers of material changes via email or a prominent notice on the website at least 30 days before the changes take effect.
